Background

Two former top executives linked to the collapsed cryptocurrency exchange FTX have settled with the U.S. Commodity Futures Trading Commission (CFTC) without facing monetary penalties, a decision the regulator attributed to their significant cooperation in the broader investigation.

Terms of the Settlement

The agreement, filed and approved in a Manhattan federal court, resolves the CFTC's civil action against former Alameda Research CEO Caroline Ellison and FTX co-founder Gary Wang. The agency said it did not pursue fines or the disgorgement of illegal profits because of their assistance in the case against FTX founder Sam Bankman-Fried.

"Today’s resolution further underscores the high value this division places on robust cooperation," CFTC Enforcement Director David Miller said in a statement. Instead of financial penalties, the settlement imposes other restrictions:

  • Caroline Ellison: Faces a five-year trading ban and a 10-year prohibition from registering with the CFTC.
  • Gary Wang: Received a five-year trading ban and an eight-year registration prohibition.

Context of the FTX Prosecution

This settlement is the latest development following the dramatic 2022 collapse of FTX, which filed for bankruptcy after prosecutors uncovered what they described as a multi-year fraud that misappropriated billions of dollars from customers and lenders. Both Ellison and Wang pleaded guilty to criminal charges and served as key prosecution witnesses in the trial that led to Bankman-Fried's conviction.

Bankman-Fried is currently serving a 25-year prison sentence. For their roles, Ellison was sentenced to two years in prison in 2024, while Wang avoided prison time. The decision to waive fines for the pair contrasts with the CFTC's settlement in April with former FTX engineering chief Nishad Singh, who was ordered to return $3.7 million in profits in addition to facing trading and registration bans.
