The conflict centers on AppLovin's allegation that Unity’s Ad Quality software development kit (SDK) improperly collects data on ads served through AppLovin's MAX platform. AppLovin claims Unity may have used this information to train its own advertising models.
Unity disputes the allegations, contending that its Ad Quality tool is authorized by publishers and falls outside the scope of the companies' existing bidding agreements. According to Wedbush analyst Alicia Reese, the court's decision was on the request for interim relief, not the underlying merits of the case, which is now proceeding to private arbitration.
Market Impact and Competitive Landscape
Reese noted in a report that the ruling highlights a "conspicuous" competitive shift as Unity's advertising business gains significant market traction. The decision could make it more challenging for AppLovin to protect data generated through its MAX platform.
AdWhile the dispute is not expected to impact the core performance of AppLovin's AXON technology, stronger bidding from a rapidly growing Unity within MAX auctions could create a "headwind" for AppLovin’s take rate, the analyst wrote. AppLovin is seen as unlikely to restrict Unity's access to MAX, as doing so could harm publisher revenues and potentially invite an antitrust challenge.
Unity's Rapid Growth
The legal battle unfolds as Unity's ad business demonstrates robust growth. According to company reports cited by Wedbush:
- Vector revenue rose 23% sequentially in the second quarter, roughly double its guidance.
- The business reached a $1 billion annualized run rate two quarters ahead of schedule.
- Strategic Grow revenue increased 63% year-over-year.
Unity anticipates another 19% to 21% sequential increase in Vector revenue in the third quarter. Investors will be watching for the court’s written order, a hearing on sealing scheduled for Oct. 23, and any further developments in the arbitration process.
