Allegations of Prior Representation
Muddy Waters asserts that Quinn Emanuel advised the firm and Block in 2022 during federal investigations into activist short sellers. In its court filing, Muddy Waters stated that during this period, the law firm gained access to confidential information regarding its business model, research operations, and trading practices.
The short-selling firm argues this prior relationship makes it unethical for Quinn Emanuel to now represent an adversary in a related matter. "This case presents an unfortunate example of a law firm suing its former client after obtaining relevant confidential information," Muddy Waters stated in its filing. The firm also accused Quinn Emanuel of falsely claiming Muddy Waters was never a client.
The Underlying Lawsuit and Responses
The legal dispute stems from a lawsuit filed last year by Techtronic Industries, the owner of brands like Milwaukee power tools. Techtronic accused Muddy Waters of conspiring to publish defamatory reports about the company to profit from a subsequent decline in its stock price, an allegation Muddy Waters has denied.
AdIn response to the disqualification motion, a spokesperson for Quinn Emanuel said in a statement, "we believe the motion is meritless and intend to oppose it." Techtronic did not provide an immediate comment on the matter. The legal team representing Techtronic includes high-profile partner Alex Spiro, known for clients such as Elon Musk.
A 'Pattern' of Conflicts
Muddy Waters' filing further alleges that conflicts of interest are an "endemic" issue at Quinn Emanuel, pointing to other recent cases where the firm was disqualified. Carson Block stated Monday that "at least eight recent conflict-related disqualifications and resignations isn’t bad luck, it’s a pattern."
This includes a recent ruling where a California judge barred the firm from a case over a conflict. The case is filed as *Techtronic Industries Company Ltd v. Muddy Waters Capital LLC* in the U.S. District Court for the Western District of Texas.
