Kalshi Blocked in Washington State Over Illegal Gambling Concerns

Summary
A Washington state judge has granted a preliminary injunction against prediction market Kalshi, halting its event contracts in the state due to likely violations of gambling laws. The ruling marks another victory for state regulators in an ongoing jurisdictional dispute with the federally-regulated platform.
A judge in Washington has granted the state's request for a preliminary injunction, effectively blocking the prediction market platform Kalshi from offering its event contracts to residents. The court found that the state successfully argued the platform's activities likely violate local gambling laws and pose a risk to consumers.
The Court's Ruling
In a decision issued Monday, Judge John McHale of the King County Superior Court sided with the state, citing a "likelihood of actual and substantial injury to Washington consumers from illegal gambling activities" if Kalshi were allowed to continue operating. The judge determined that the public interest and potential harm to consumers outweighed any harm the injunction would cause to Kalshi's business. The formal order implementing the injunction is expected to be issued on August 5.
Washington Attorney General Nick Brown praised the decision in a statement, accusing the platform of promoting "illegal betting on sports, elections... and even natural disasters." He added, "This victory is the first step toward holding Kalshi accountable."
A Widening Jurisdictional Clash
This ruling is the latest development in a broader conflict between Kalshi and state regulators over who has the authority to oversee prediction markets. Kalshi maintains that states lack the power to regulate its products.
Ad- Kalshi's Position: The company stated its disappointment, asserting that "States don’t have jurisdiction to regulate prediction markets."
- Federal Oversight: The U.S. Commodity Futures Trading Commission (CFTC) claims exclusive jurisdiction over the industry. A federal appeals court previously cited the CFTC's authority when it blocked New Jersey gaming officials from regulating Kalshi's sports-related contracts.
- State-Level Pushback: Despite the federal claim, Washington now joins Massachusetts, Michigan, Nevada, and New York in securing court orders to restrict Kalshi's operations.
The Rise of Prediction Markets
Prediction markets like Kalshi and Polymarket, which allow users to wager on the outcomes of future events, have seen a significant surge in popularity. Their profile grew notably after the 2024 U.S. presidential election.
The financial scale of these markets is substantial. According to data tracker Dune Analytics, a combined $19.04 billion was wagered through Kalshi and Polymarket on the most recent soccer World Cup alone, highlighting the significant capital flowing into this contested regulatory space.
