Background

United Therapeutics Corporation (NASDAQ: UTHR) shares are continuing their upward trend after a U.S. court issued a decisive patent ruling in the company's favor, significantly limiting a key competitor and extending the market exclusivity for its core pulmonary hypertension franchise.

Decisive Patent Victory

The U.S. District Court for the District of Delaware found that rival Liquidia Corporation infringed upon United Therapeutics’ Patent No. 11,826,327. The patent covers the treatment of pulmonary hypertension with interstitial lung disease (PH-ILD) using inhaled treprostinil, the active ingredient in both companies' products.

As a result of the ruling, Liquidia must revise the label for its drug, YUTREPIA, to remove the PH-ILD indication. This decision provides a major competitive advantage for United Therapeutics, as the patent protection for this use of its drug, Tyvaso, is now expected to extend through 2042.

Analyst Upgrade Follows

In response to the legal victory, analysts at BTIG upgraded United Therapeutics stock from Neutral to Buy and set a new price target of $728. The firm noted the ruling significantly impairs Liquidia’s competitive threat in the PH-ILD market and may also create a temporary barrier in the broader pulmonary arterial hypertension space.

While the broader analyst community holds a consensus Buy rating on the stock, a recent Sell initiation from Goldman Sachs with a $321 price target represents a notable dissenting opinion.

Broader Context

The positive legal news is compounded by the company's ongoing capital return program. United Therapeutics is in the final stages of a $477.6 million accelerated share repurchase with Citibank, which is the last portion of a larger $2 billion buyback authorization. Such programs reduce the number of shares outstanding, which can be supportive of the stock price.

The company-specific catalysts have allowed United Therapeutics to outperform in a mixed market environment, where broader indices have recently been pressured by rising Treasury yields.
