Oracle Invokes Force Majeure on New Mexico AI Data Center Amid Regulatory Delays

Summary
Oracle has issued a force majeure notice for its massive 'Project Jupiter' AI data center, citing regulatory setbacks that threaten the project's 2028 launch and sending shares of its partners lower.
Oracle Corp. has issued a force majeure notice to the developer of its massive "Project Jupiter" artificial intelligence data center in New Mexico, a move to shield itself from financial liabilities amid significant regulatory delays. The action, reported by Bloomberg, signals growing concerns that the cornerstone project could miss its 2028 launch date, creating uncertainty for Oracle's ambitious AI infrastructure expansion.
Pipeline Impasse Strands Power Supply
The core of the dispute stems from the project's power source. The 2.45-gigawatt campus is designed to be powered by solid oxide fuel cells from Bloom Energy, a technology chosen for its minimal water consumption in the arid region. However, these fuel cells depend on a steady supply of natural gas.
That supply is contingent on the construction of a 17-mile pipeline by Energy Transfer LP, dubbed the "Green Chile Project." According to the report, this pipeline has been delayed from its original August 2026 target to at least February 2027 after the New Mexico State Land Office repeatedly denied right-of-way permits, citing climate and resource concerns. Without the pipeline, the power generation system for the data center cannot operate.
Market Reacts to Project Uncertainty
The news triggered a sell-off in the shares of companies tied to the project as investors priced in the risk of costly delays. A force majeure clause allows a party to suspend contractual obligations due to unforeseen and unavoidable events.
AdKey stock movements included:
- Oracle (ORCL): Shares fell 4% on concerns about the potential disruption to its AI capacity rollout.
- Blue Owl Capital (OWL): The parent of the project's developer, Stack Infrastructure, saw its stock decline by 4%.
- Bloom Energy (BE): Shares tumbled 6%, reflecting its critical role as the stranded power provider.
A Test Case for AI Infrastructure
While Oracle stated the force majeure notice was a "precautionary measure" and that "Project Jupiter remains on our planned schedule," the legal maneuver highlights escalating friction over the AI boom's environmental footprint. The $165 billion project is a key part of the larger Stargate AI initiative and is now a high-profile example of how local land use and environmental regulations can pose significant challenges to the development of large-scale AI infrastructure.
