Background

Shares of litigation finance firm Burford Capital Ltd. (BURF) surged more than 12% on Monday after a federal jury ruled that Apple Inc. must pay over $5.7 billion in a patent infringement case in which Burford has a significant financial interest. The stock's rise marked its largest single-day gain since late March.

The Verdict and Burford's Stake

A federal jury in San Diego on September 25 found that Apple infringed on patents owned by Taction Technology Inc. related to vibration-based technology, according to reports. The resulting $5.7 billion award is among the largest patent verdicts in U.S. history.

Burford Capital's connection to the case was established through court discovery, which showed that an indirect subsidiary, Kenosha Investments LP, had provided financing to Taction. In a statement, Burford said that if the full verdict amount were paid, its entitlement would be approximately $1.4 billion, split between its balance sheet and its investment funds.

Despite the favorable verdict, Burford Capital cautioned investors that the outcome is far from certain. The company emphasized that the award is subject to significant legal challenges and collection risks.

Key points highlighted by the company include:

  • The jury verdict does not represent a final judgment or cash received.
  • Apple has already filed a motion asking the court to set aside the verdict.
  • The case will likely undergo post-trial and appellate proceedings, and the U.S. Court of Appeals for the Federal Circuit is known for scrutinizing large verdicts.
  • Litigation matters often resolve for amounts below the initial jury award, and the parties could settle for a considerably smaller sum.

Burford stated that its ultimate entitlement will depend on the final resolution amount and the specific terms of its financing agreement, including applicable fees, expenses, and taxes.
